Chemung County challenges state executive order affecting jail staffing

Chemung County has initiated legal proceedings against New York State Governor Kathleen Hochul and Commissioner Rossana Rosado of the Division of Criminal Justice Services. The lawsuit, filed by County Executive Christopher J. Moss and Sheriff William Schrom, contests Executive Order 47.3, which bars local governments from employing correctional officers who participated in a recent strike.

The county contends that this order unlawfully limits its hiring capabilities, worsens staffing shortages at Chemung County Jail, and unjustly blacklists affected workers. The lawsuit aims to overturn the directive, arguing it exceeds the governor's authority and unfairly penalizes qualified candidates seeking employment in county correctional facilities.

"We are taking this action to protect our ability to staff our jail with experienced personnel and to stand against unconstitutional overreach," stated County Sheriff Bill Schrom. Additionally, County Executive Chris Moss remarked, “This order places an unnecessary burden on local governments and disregards our authority to make hiring decisions that best serve our community."

Filed in Albany County Supreme Court, Chemung County is requesting an expedited ruling due to urgent staffing requirements.
